First prison sentence handed down for breach of WHS duty offence

Despite being available to courts for a number of decades, for the first time in any Australian jurisdiction (to Sparke Helmore’s knowledge), an individual has been sentenced to six months’ imprisonment following breaches of WHS duty provisions relating to her involvement in a 2017 workplace fatality.
